Contractual Terms and Conditions of Carriage on NOBLESS LINE Routes Operated by Nobless line, s.r.o.

I. Scope of Application

The Contractual Conditions of Carriage on NOBLESS LINE Routes (hereinafter referred to as the “Terms and Conditions of Carriage”) set forth the conditions for the carriage of passengers and baggage in vehicles on routes operated by Nobless line, s.r.o., with its registered office at Václavské náměstí 823/19, 110 00 Prague 1, Company ID No.: 25609815.

II. Definition of Certain Terms

For the purposes of these Terms and Conditions of Carriage, the following definitions apply:

  1. “Transportation on NOBLESS LINE routes” means the activity of the carrier, i.e., Nobless line, s.r.o., consisting of the transportation of passengers in the carrier’s vehicles in accordance with a pre-published schedule, fare schedule, and these Conditions of Carriage;
  2. “transport contract” means the contractual relationship between the carrier and the passenger, the establishment and terms of which are governed by the laws of the Czech Republic and these Terms and Conditions of Carriage;
  3. “Valid Fares” means the prices for the transportation (fare) of passengers and baggage as bindingly set by the carrier;
  4. “ticket” means a valid travel document that entitles the passenger to transportation in accordance with Article III of these Conditions of Carriage;
  5. travel documents: the documents required to cross the state borders of both transit countries—i.e., countries through which the passenger travels—and destination countries;
  6. “luggage” means an easily portable item that, given its dimensions and weight, can be easily placed in a vehicle and that also meets the conditions for transport under these Terms and Conditions of Carriage;
  7. generally binding legal regulations, in particular Act No. 111/1994 Coll., on Road Transport, as amended, Decree No. 175/2000 Coll., on Transport Regulations, Act No. 89/2012 Coll., the Civil Code, and any international conventions to which the Czech Republic is a party.

III. Formation and Performance of the Contract for the Carriage of Passengers

  1. Upon the conclusion of a contract of carriage for the transport of passengers (hereinafter referred to as the “contract of carriage”), a legal relationship arises between the carrier and the passenger based on generally binding legal regulations and these Conditions of Carriage, which consists, in particular, of the carrier’s obligation to transport the passenger from the point of origin to the destination station via the carrier’s services listed in the timetable, and the passenger’s obligation to comply with these Conditions of Carriage, in particular to pay the carrier the price for transportation (hereinafter referred to as the “fare”) in accordance with the currently valid fare schedule.
  2. The contract of carriage is concluded upon payment of the fare by the passenger or, if the passenger chooses to pay the fare only upon boarding the vehicle, upon the passenger’s making a reservation and the carrier’s confirmation of the reservation.
  3. The contract of carriage is fulfilled by the proper performance of the carriage within the agreed scope in accordance with the concluded contract of carriage.
  4. The contract of carriage is also deemed to have been fulfilled if the transportation is provided to a scope other than that agreed upon, provided that the passenger was lawfully excluded from transport by the driver or another person acting on behalf of the carrier who presents a carrier ID authorizing them to give instructions and orders to passengers (hereinafter referred to as the “authorized person”).
  5. Anyone who purchases a ticket on vehicles operated by Nobless line, s.r.o., or through a contracted seller or by any other means, expresses their consent to these Terms and Conditions of Carriage, which are available on the carrier’s website at www.noblessline.cz. The subject matter of the contract of carriage concluded between the carrier and the passenger is solely the transportation of passengers and baggage in accordance with these Conditions of Carriage. Premium services (in particular, the provision of beverages, light refreshments, daily newspapers and magazines, movie screenings, and Wi-Fi internet access) are provided beyond the scope of the transportation contract based on the carrier’s operational capabilities, and the failure to provide them does not entitle the passenger to any compensation.

IV. Ticket and Its Requirements

  1. For the purpose of verifying the validity of the right to transportation and for the duration of the journey, the passenger must present a valid ticket (hereinafter referred to as the “ticket”), unless otherwise specified below. The passenger is required to retain a copy of the ticket (passenger document) for possible inspection and must present it to an authorized representative of the carrier upon request.
  2. The ticket shall include, in particular:
    • a) the name (company name) of the carrier entering into the contract of carriage,
    • b) the departure and destination stations,
    • c) the fare amount,
    • d) validity information,
    • e) the passenger’s first and last name.
  3. A ticket is invalid if:
    • a) it is damaged to the extent that the information specified in Article IV, paragraph 2 of these Terms and Conditions of Carriage—which is necessary to verify the correctness of its use—is not legible,
    • b) the information on the ticket does not correspond to the facts or has been altered without authorization,
    • c) it was issued in a name other than that of the passenger who presented it,
    • d) the document is not an original.

V. Reservations, Payment of Fares and Fees

  1. Passengers may reserve a ticket in the following ways:
    • a) online via the carrier’s reservation system on the carrier’s website at www.noblessline.cz,
    • b) by phone at 602 333 369,
    • c) by sending a reservation request to the carrier’s email address rezervace@noblessline.cz and receiving confirmation of the reservation from the carrier,
    • d) by sending a message via the carrier’s social media accounts (Facebook, Instagram, X) and receiving confirmation of the reservation from the carrier.
  2. Passengers pay the fare for a ticket according to the currently valid fare schedule. When a ticket is sold in the Czech Republic, the price is determined according to the fare schedule listed in Czech korunas. When purchasing a ticket in a foreign country, the fare is paid according to the fare schedule specified in the relevant foreign currency. The passenger is entitled to choose the currency in which the fare will be paid.
  3. Passengers pay the fare:
    • a) upon boarding the vehicle, and the carrier will issue a ticket in exchange for the fare paid;
    • b) in advance by bank transfer or through a payment gateway, and the carrier sends the passenger a booking confirmation via email; the passenger receives the ticket upon boarding the vehicle;
    • c) by presenting a pre-purchased voucher upon boarding the vehicle, and the carrier will issue a ticket to the passenger.
  4. The carrier reserves the right to specify in its reservation system that a passenger’s reservation must be paid for in advance.
  5. When purchasing a ticket, the passenger is required to verify that the issued ticket matches the information provided. If the ticket does not match the entered information, the passenger is entitled to refuse the ticket. If the passenger later points out a discrepancy in the information on the ticket, the matter will be handled in accordance with the applicable cancellation policy, provided that this does not constitute a complaint.
  6. A passenger requesting a discount is required to provide proof of eligibility for the discount, both at the time of ticket purchase and during the trip.
  7. Special discounts and discounts offered as part of promotional campaigns are always governed by the terms and conditions published for the specific type of discount or promotional campaign.

VI. Cancellation of a Reservation or a Paid Ticket

  1. If a passenger has paid the fare in advance, the first change to the ticket’s travel date is free of charge (the change must be made at least 8 hours before the departure of the service). If the passenger changes the date more than once or cancels the ticket within 24 hours before the departure of the service, the cancellation fee is 10% of the fare; ifif they change the reservation date or cancel the ticket between 24 and 8 hours before departure, the cancellation fee is 50% of the fare; if theythe reservation date or cancel the ticket less than 8 hours before departure, the cancellation fee is 100% of the fare.
  2. If a passenger makes a reservation with cash payment upon boarding the bus, the first change to the ticket date is free of charge (the change must be made at least 8 hours before the departure of the bus). If the passenger changes the date or cancels the reservation less than 8 hours before departure, they are considered to have failed to show up for departure. In such a case, they permanently lose the option to make reservations with cash payment upon boarding. However, they may still make reservations with fare payment in advance.
  3. If a passenger fails to cancel an unpaid reservation in a timely manner and does not show up for departure, this constitutes a violation of the contractual terms of carriage. In such a case, the passenger is required to pay the carrier a contractual penalty of 1,300 CZK / 55 CHF / 60 EUR for each seat in that reservation.

Reservations, or refunds for tickets that have already been paid for, must be canceled by calling +420 602 333 369 or by emailing rezervace@noblessline.cz no later than 8 hours before the departure of the service.

The carrier reserves the right to handle each case individually.

VII. Schedules

  1. Arrival and departure times are always listed in local time in the timetables and on tickets. The carrier reserves the right to make changes to the timetables, subject to the provisions of Article XII, Paragraph 1 of these Terms and Conditions of Carriage.
  2. Departure points and stops for individual routes may change during the year. Passengers are therefore advised to check with check-in staff or visit the carrier’s website at www.noblessline.cz before departure.

VIII. Travel Documents

  1. Each passenger is personally responsible for complying with the passport and customs regulations of the countries to which they are traveling or through which they are passing, and for meeting the conditions for entry into the destination country. All costs incurred due to non-compliance with these regulations shall be borne by the passenger. If customs or police authorities do not permit a passenger to continue their journey, the passenger is not entitled to a refund of the fare—not even a partial refund—or any other compensation.
  2. The information on the ticket must match the information on the passenger’s applicable travel document.

IX. Conditions for the Carriage of Passengers and Baggage

  1. The carrier is entitled to refuse to transport a passenger who shows signs of intoxication or the use of toxic or narcotic substances, a passenger whose bodily or clothing soiling violates customary hygiene standards or could cause soiling of other passengers or the vehicle’s interior.
  2. Passengers are required to check in no later than 20 minutes before the scheduled departure of the service. If a passenger fails to arrive for check-in within the specified time, they shall be deemed not to have arrived for transport, and the carrier is entitled to immediately offer their reserved seat for sale to other interested passengers. In such a case, the passenger forfeits the right to transportation as well as the right to a refund of the fare or any other compensation.
  3. Due to regulations in effect in transit and destination countries, persons under 18 years of age are transported on NOBLESS LINE routes only when accompanied by a person 18 years of age or older. Persons under the age of 18 may be transported unaccompanied by an adult only with the carrier’s prior consent and in accordance with predetermined rules.
    • a) A person under the age of 18 will be seated in the front section of the bus under constant surveillance by security cameras.
    • b) A person under the age of 18 must have valid travel documents (passport or ID card).
    • c) Unless otherwise agreed upon individually with the carrier, a person under the age of 18 must be accompanied to the departure point, and a person picking them up must be waiting at the destination at least 20 minutes before the scheduled arrival time.
    • d) The reservation must always include a valid phone number for the person who will accompany the child to the departure point.
    • e) When checking in, a person under the age of 18 must provide the driver with a power of attorney, including valid contact information.
    • f) The transportation of an unaccompanied person under the age of 18 is considered an additional service and is subject to a fee of 1,300 CZK / 55 CHF / 60 EUR.
  4. Short restroom breaks or snack breaks during the trip are not mandatory. Their frequency and duration depend on the route schedule. Passengers are required to adhere to the pre-announced duration of these breaks. If a passenger does not board the vehicle within 5 minutes after the break has ended, they are deemed to have forfeited the right to continue the journey. In this case, the passenger is not entitled to a refund of the fare for the untraveled portion of the journey or to any other compensation.
  5. Smoking is prohibited on the vehicle. The carrier is authorized to impose a fine of 2,000 CZK for violation of this prohibition, payable by the end of the given trip.
  6. Furthermore, it is not permitted to consume narcotic or psychotropic substances or alcoholic beverages brought onto the vehicle. A passenger who shows signs of intoxication will not be permitted to board, and will not be entitled to a refund of the fare. Similarly, on NOBLESS LINE routes, it is prohibited to transport narcotics and non-prescription medications that are not intended for the passenger’s prescribed treatment. The carrier reserves the right to deny boarding to passengers who do not comply with these provisions or to remove them from the vehicle without entitlement to a refund of the fare.
  7. It is prohibited to use audio players, any musical instruments, or other sound sources at a volume that may be disruptive to other passengers.
  8. A passenger who has soiled or damaged the vehicle, its equipment, or other property of the carrier; who endangers the smooth flow of traffic; or who otherwise violates the provisions of Act No. 111/1994 Coll., on Road Transport, Act No. 266/1994 Coll., on Railways, Decree of the Ministry of Transport No. 175/2000 Coll., on the Rules of Carriage for Public Rail and Road Passenger Transport, and these Terms and Conditions of Carriage, the passenger shall pay, in addition to compensation for damages, a contractual penalty of 1,000 CZK for each individual violation.
  9. A passenger is entitled to check baggage in the luggage compartment with a value exceeding 10,000 CZK only if they have notified the carrier of its value prior to acceptance for transport and have paid a special transport fee in accordance with the carrier’s current tariff.

X. Passengers’ Obligations, Compliance with the Carrier’s Instructions, and Safety of Operations

  1. Passengers are required, at all times while on board the vehicle and in its immediate vicinity, to follow the instructions of the driver and other authorized personnel of the carrier, issued in accordance with legal regulations and these Terms and Conditions of Carriage, particularly in the interest of safety, the smooth flow of traffic, the protection of personal health and property, and the maintenance of order.
  2. Passengers are required to conduct themselves in a manner that does not disturb the peace and comfort of other passengers. During nighttime hours (particularly between 10:00 p.m. and 6:00 a.m.), passengers are required to observe enhanced nighttime quiet hours, specifically refraining from:
    • a) loud conversations, shouting, and other noisy behavior,
    • b) using audio-playing devices without headphones,
    • c) any other activity that unreasonably disturbs other passengers or the crew.
  3. Passengers are required to refrain from any unauthorized tampering with the vehicle’s technical, safety, and protective equipment, particularly emergency exits, fire extinguishers, emergency hammers, switches, door and restroom controls, or CCTV system components, unless their use is necessary in the event of an emergency.
  4. Passengers must not, without good reason, stand, sit, or lie down in the aisles, on stairways, or in the vicinity of emergency exits; obstruct the passage of other passengers or crew members; or store luggage in a manner that obstructs passage or evacuation or jeopardizes operational safety; They are required to use their assigned seats and follow the crew’s instructions regarding seating and luggage storage.
  5. Passengers are required to comply with all safety and operational instructions issued by the carrier on board the vehicle (e.g., via informational leaflets, pictograms, operating rules, or audio announcements). These instructions are a binding part of these Conditions of Carriage.
  6. A gross or repeated violation of the obligations set forth in this Article is considered a material breach of the Conditions of Carriage and may result in the passenger’s removal from the vehicle without entitlement to a refund of the fare or any other compensation; This does not affect the carrier’s right to claim damages or a contractual penalty pursuant to Article IX, paragraph 8, of these Conditions of Carriage.

XI. Video Surveillance, Safety, and Property Protection

  1. The carrier hereby informs passengers that the interior of the bus, storage areas, luggage compartments, and access areas may be monitored by a camera system for the purpose of:
    • a) ensuring the safety of passengers and crew,
    • b) protecting health,
    • c) protecting the property of passengers and the carrier,
    • d) preventing unlawful conduct,
    • e) documenting any extraordinary events (damage, complaints, safety incidents).
  2. Video recordings are retained for as long as strictly necessary, but no longer than the period specified by law, the carrier’s internal rules, and the technical capabilities of the system.
  3. Camera recordings may only be processed by:
    • a) by authorized employees of the carrier,
    • b) by the Police of the Czech Republic or foreign authorities conducting criminal or administrative proceedings,
    • c) entities authorized to investigate emergencies, complaints, or claims.
  4. Camera footage may be used as evidence in:
    • a) complaint proceedings,
    • b) investigations of claims,
    • c) the protection of the carrier’s legitimate interests,
    • d) the assessment of passengers’ claims against the carrier.
  5. By handing over baggage for transport, the passenger acknowledges that access areas to baggage storage compartments may be monitored and that the footage may be used to demonstrate how the baggage was handled, handed over, received, or processed.

XII. Rights of the Carrier

  1. The carrier reserves the right to make changes to the schedules, for which it is entitled to withdraw from the contract of carriage no later than 3 days before the date on which the carriage was to commence, by posting a notice to this effect on the carrier’s website at www.noblessline.cz, by telephone, or via electronic means of communication, in the case of passengers who have provided the carrier with a telephone number or the information necessary for electronic communication.
  2. The carrier also has the right to cancel the service or part thereof due to a force majeure event that it could not have prevented even by exerting all efforts that could reasonably be expected of it.
  3. The provisions of Article XI of these Terms and Conditions of Carriage apply to in-vehicle video surveillance and the conditions for processing the recordings.
  4. The carrier’s liability covers damages that occur during the period from the passenger’s boarding of the vehicle until their alighting, including these two actions.

XIII. Passenger Obligations

  1. In the event of failure to comply with the provisions set forth in Article VIII, as well as other generally binding regulations, the passenger may be excluded from transport. In such cases, the carrier is immediately relieved of all contractual obligations to the passenger and is not obligated to reimburse the passenger, even partially, for the fare or any other compensation or damages.
  2. When planning a connecting trip, the passenger must take into account the possibility of delays. The carrier bears no liability for damages resulting from delays, service cancellations, or missed connections that the carrier can demonstrably prove were not its fault.
  3. If a seat is equipped with a seat belt, the passenger is required to wear it at all times during the trip.

XIV. Complaints

  1. The terms of the contract of carriage, including the carrier’s liability, are governed by generally applicable legal regulations.
  2. Any complaint must be filed no later than 6 months from the date of the trip’s completion and must be accompanied by the ticket. Complaints may be filed at the location where the ticket was purchased or at the address of the carrier operating the relevant route. The complaint will be resolved within 30 days of its receipt by the carrier, either by handing it over to an authorized representative of the carrier on NOBLESS LINE routes, by mailing it to NOBLESS LINE, s.r.o., Václavské náměstí 19, 110 00 Prague 1 – Nové Město, or electronically via email to: noblessline@noblessline.cz.
  3. Claims for loss, theft, or damage to baggage must be filed by the passenger immediately upon receipt of the baggage at the destination stop with an authorized representative of the carrier. The representative is required to confirm the extent of the damage or loss to the passenger in writing. This confirmation, together with the ticket, constitutes an integral part of the baggage claim.
  4. Compensation for lost baggage and damage to checked baggage may not exceed the limits set by generally applicable legal regulations. If the value of the baggage exceeds 10,000 CZK and the passenger fails to notify the carrier of this and therefore does not pay the special fee according to the current fare schedule in accordance with Article IX, paragraph 9 of these Conditions of Carriage, it is recommended that the passenger take out supplementary baggage insurance.
  5. The carrier is not liable for baggage transported in the passenger compartment, except in the event of theft or loss resulting from a traffic accident and provided that the baggage was under the carrier’s supervision. The same applies to personal belongings and items that the passenger is wearing or carrying.
  6. When transferring to another vehicle, the passenger is fully responsible for transferring their own baggage.
  7. The carrier is authorized to use video recordings as evidence when assessing the validity of a claim regarding the loss, damage, or theft of baggage. If the video footage does not prove that the baggage was handed over to the carrier or does not show the existence of the claimed baggage during loading or unloading, the passenger bears the burden of proof regarding the alleged claim.

XV. Transportation of Baggage, Passengers, and Animals

  1. In accordance with generally applicable legal regulations, baggage is transported separately from the passenger as checked baggage and together with the passenger in the vehicle and under the passenger’s supervision as other baggage.
  2. Luggage or the contents of luggage must not include items that, due to their nature, may cause damage to the vehicle, as well as harm to the life and health of persons or to their property, or bulky items, unless otherwise specified below.
  3. Items that may not constitute luggage or be included in luggage include, in particular, loaded firearms, explosive, poisonous, radioactive, volatile, or corrosive items; items that may cause infection; items that cannot be placed in the vehicle’s designated luggage compartment; or items weighing more than 30 kg, unless otherwise specified below.
  4. Checked baggage is transported in the vehicle’s luggage compartment and must be marked with a NOBLESSLINE baggage tag. Passengers are required to fill in the required information on the baggage tag.
  5. Unless otherwise specified in the terms and conditions published in the individual schedules, the maximum permitted dimensions for luggage are 30×50×80 cm, and the maximum permitted weight is 30 kg. Passengers are entitled to transport two such checked bags free of charge. Each additional bag or bag of non-standard dimensions is subject to a fee of 500 CZK / 20 CHF / 20 EUR per piece.
  6. Passengers are entitled to transport one carry-on bag with maximum dimensions of 20×30×40 cm free of charge. Carry-on baggage is easily portable luggage that the passenger keeps with them and can be placed in the vehicle under or above the passenger’s seat. Luggage must be stowed in the vehicle in such a way that it does not endanger the safety or interests of other passengers, or as directed by the driver or an authorized person. The carrier is not liable for luggage or items placed in the passenger compartment.
  7. The transport of oversized luggage, skis, and snowboards is permitted on NOBLESS LINE routes under the following conditions:
    • a) A space for oversized luggage may only be reserved by a passenger who has already purchased a ticket,
    • b) transport is permitted only on selected routes, on designated sections of the route, or to selected destinations,
    • c) transport is permitted only during the specified period,
    • d) Space for transporting this type of luggage is limited and subject to reservation; reservations may only be made by the NOBLESS LINE dispatch center based on available vehicle capacity. Passengers are required to notify the NOBLESS LINE dispatch center at least 3 days prior to the scheduled departure,
    • e) A fee of 500 CZK / 20 CHF / 20 EUR per piece applies for the transport of oversized luggage,
    • f) The transport of skis and snowboards is subject to a fee according to the fare schedule and is subject to reservation in accordance with points 7 a–d) of this article;
    • g) Skis or snowboards must be packed in a bag so that their sharp edges do not damage other luggage.
  8. The transport of animals and unaccompanied shipments is not permitted on NOBLESS LINE routes.
  9. Children 12 years of age and younger are not permitted to travel in the front seats or in the seats behind the front and rear staircases. When purchasing a ticket, the passenger is required to indicate that the seat is for a passenger under 12 years of age.

XVI. Checking Baggage for Transport

  1. If the transport of baggage is subject to a fee, the passenger is required to pay the applicable amount before the baggage is loaded onto the vehicle.
  2. Passengers are required to follow the instructions of the carrier, government authorities, and veterinary authorities during all security, customs, police, and veterinary inspections and checks.
  3. When transferring to another vehicle, the passenger is always responsible for transferring all of their luggage to the vehicle in which they will continue their journey.

XVII. Claims for Damage to or Loss of Transported Luggage

  1. Luggage is considered validly delivered if the carrier, acting in good faith, hands it over to the holder of the luggage tag. If a baggage tag is not presented, the carrier is obligated to deliver the baggage to the person who proves their right to it. The carrier will store unclaimed baggage in a safe and suitable place at the passenger’s expense.
  2. If the passenger accepts the delivered baggage without reservation, the baggage is deemed to have been accepted in complete and good condition, unless the passenger proves otherwise.
  3. The carrier is liable for damage to checked baggage for the reasons and up to the limits set forth in generally binding legal regulations.
  4. If checked baggage is lost, or if- if the passenger discovers, upon collection of the checked baggage, obvious damage or incompleteness of the baggage, or circumstances indicating such, the passenger shall immediately ask a carrier employee to assess the condition of the checked baggage and to draw up a report. This report, together with the ticket and the baggage tag, constitutes an essential part of the claim, which must be filed in writing.
  5. In the event of the total loss of checked baggage, the passenger is entitled to a refund of the baggage fee paid and to compensation for the proven value of the lost baggage at the time it was checked for transport, up to a maximum of 10,000 CZK. If the passenger has paid a special fee in accordance with the tariff as set forth in Article IX, paragraph 9 of these Conditions of Carriage, the passenger is entitled to compensation corresponding to the value of the baggage item(s) that the passenger reported to the carrier in accordance with this provision.
  6. In the event of damage to checked baggage, the passenger is entitled to compensation corresponding to the damage incurred to the baggage, up to a maximum of 10,000 CZK; however, if the passenger has paid a special fee in accordance with the tariff as set forth in Article IX, paragraph 9 of these Conditions of Carriage, the passenger is entitled to compensation corresponding to the value of the baggage as declared to the carrier under this provision.
  7. Compensation in the event of loss of checked baggage or damage to checked baggage is governed by generally applicable legal regulations and the terms under which the baggage was accepted for transport pursuant to these Conditions of Carriage.
  8. NOBLESS LINE, s.r.o. is not liable for damage to checked baggage if the loss, damage, or delayed delivery of the checked baggage was caused under the following conditions:
    • a) the packaging is not suitable for the nature of the item being transported,
    • b) the baggage contains items that are not permitted to be included in baggage, such as live animals or perishable items, or if the contents of the baggage were falsely declared,
    • c) the baggage contains money, securities, personal documents, or valuables,
    • d) circumstances arose, such as natural disasters or the actions of third parties, which the carrier could not have prevented even by exercising all due diligence,
    • e) the passenger’s actions result in damage to or loss of the passenger’s checked baggage,
    • f) force majeure that the carrier could not have prevented even by exercising all due diligence.
  9. The carrier bears no liability for other baggage and items transported in the passenger compartment, except for damage caused by the operation of the carrier’s vehicle as a motor vehicle.

XVIII. Gift Voucher

As part of its services, the carrier offers gift vouchers in various denominations. A gift voucher is valid for 12 months from the date of issue. Additional terms and conditions for redeeming the voucher are specified by the carrier directly on the gift voucher.

XIX. Security and Data Protection

  1. The Carrier declares that all passengers’ personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and Act No. 110/2019 Coll., on the Processing of Personal Data.
  2. Passengers’ personal data is processed for the following purposes:
    • a) concluding and fulfilling the contract of carriage,
    • b) managing user reservations and communicating with passengers,
    • c) handling claims, complaints, and insurance or damage incidents,
    • d) protecting the carrier’s legitimate interests, particularly in connection with the operation of a video surveillance system,
    • e) sending marketing communications from the carrier, provided the passenger has given consent.
  3. Personal data may only be disclosed to:
    • a) authorized employees of the carrier,
    • b) entities providing operational and technical services to the carrier (e.g., IT, payment gateways),
    • c) public authorities, if required by law,
    • d) contractual partners to the extent necessary to provide the services requested by the passenger.
  4. The retention period for personal data is determined in accordance with legal regulations and the carrier’s operational needs; data is not retained longer than is necessary for the specified purposes of processing.
  5. The passenger has the right to request from the carrier:
    • a) access to personal data,
    • b) the correction or updating of such data,
    • c) restriction of processing or erasure, provided the conditions of the GDPR are met,
    • d) data portability, if technically feasible,
    • e) to object to processing, particularly in the case of direct marketing.
  6. Passengers may withdraw their consent to receive marketing communications at any time by contacting the carrier using the contact information provided.
  7. Detailed information on the processing of personal data, including the CCTV system, is provided in the Personal Data Processing Policy, which is available on the carrier’s website.

XX. Final Provisions

  1. All legal relationships arising from or in connection with the contract of carriage shall be governed by the laws of the Czech Republic, unless otherwise provided by mandatory legal regulations.
  2. Any disputes arising between the carrier and the passenger shall—to the extent permitted by generally applicable laws—be heard and decided by the courts of the Czech Republic. If the passenger is a consumer, this provision does not affect their right to file a lawsuit with the court having jurisdiction over their place of residence or with another court designated by mandatory legal provisions.
  3. If any provision of these Terms and Conditions of Carriage is or becomes invalid, ineffective, or unenforceable, this shall not affect the validity, effectiveness, and enforceability of the remaining provisions. The invalid or unenforceable provision shall be replaced by a provision that most closely approximates the original intent in its purpose.
  4. These Terms and Conditions of Carriage are binding upon their publication on the carrier’s website and apply to all shipments made after their effective date.
  5. These Terms and Conditions of Carriage shall take effect on December 1, 2025.
